Haha nothing happened to it. The drive side down bar that is bent is done intentionally by the manufacturer. Just part of the engineering behind this particular frame design. Try to find another '06 or '05 7point rear triangle shot, and you'll see what I'm saying. Also, the tire doesnt come close to rubbing, the depth perception of this photo just makes it look that way.
